Appointing an Attorney and Guardian


There may come a time in your life when you can’t make decisions for yourself because of a mental or physical incapacity. If this happens it can create a difficult legal and bureaucratic mess that your loved ones will have to deal with.


Appointing attorneys and guardians allows you to choose people to “stand in your shoes” and make critical decisions for you when they need to be made. This eases the burden on your family.


If you lose capacity without a validly appointed Guardian or Attorney, only a Court or Tribunal can appoint them for you.


This involves a legal process that can be costly and time-consuming. The person ultimately appointed by the courts may not be the person you would have chosen. It may be a stranger who does not understand what you want.
